An offer letter is a formal document issued by an employer to a prospective employee that confirms the offer of employment. An eSigned offer letter is legally equivalent to a handwritten signed offer letter under Section 3A of the Information Technology Act, 2000. The IT (Electronic Signature) Rules, 2015 specifically recognize Aadhaar OTP-based eSign as a valid electronic signature technique. Documents eSigned this way are admissible as electronic evidence under Section 65B of the Indian Evidence Act (now Section 63 of the Bharatiya Sakshya Adhiniyam, 2023). Frequently asked questions

Is an eSigned offer letter legally valid in India?
Yes. Aadhaar eSign is recognized under Section 3A of the IT Act, 2000 and carries the same legal weight as a handwritten signature. An eSigned offer letter is admissible in court, accepted by banks for salary accounts, and recognized by the income tax department for TDS.
Does the candidate need an Aadhaar to sign?
Yes. The signer must have an active Aadhaar number with a mobile number linked to it. This is how UIDAI sends the OTP at the time of signing. If the candidate doesn't have an Aadhaar, they can't use this method and will need to sign physically or via DSC.
Can I send offer letters to candidates in other cities?
Absolutely. The candidate receives a signing link by email and can sign from anywhere in India (or abroad, as long as their Aadhaar-linked Indian mobile number can receive the OTP). No need to courier the offer letter or ask them to travel.
What if the candidate rejects the offer?
They simply don't sign. The offer letter remains unsigned in the SignSetu dashboard and you're not charged for the signature. You can cancel the pending offer anytime.
Do I need a separate NDA or is the offer letter enough?
The offer letter usually contains a basic confidentiality clause that covers pre-employment discussions. For full IP protection during employment, you should have the candidate sign a separate NDA and employment contract after they accept the offer.
Is the eSigned offer letter accepted by the candidate's next employer for background checks?
