The basics

What is an Appointment Letter?

An appointment letter is the formal document issued by an employer to an employee after they have accepted an offer and are joining the company. While the offer letter is about the offer of employment, the appointment letter is the confirmation that the employee has been appointed to the role. It typically contains the finalized terms of employment, starting date, department, reporting structure, and the policies the employee must follow.

In Indian companies, the appointment letter is often the document banks ask for when the new employee opens a salary account, and it's also used by the employee to prove current employment for rental agreements, visa applications, and loan approvals. This makes its legal validity important.

Essential clauses to include

Make sure your appointment letter includes these before you sign.

Employee name and employee ID (if assigned)
Designation and department
Date of joining and reporting location
Reporting manager and organizational structure
Confirmed CTC and salary structure (basic, HRA, special allowance, PF, etc.)
Probation period and performance review milestones
Leave entitlement and public holiday calendar
Code of conduct and company policies the employee agrees to abide by
Termination and notice period clauses
Confidentiality and IP assignment (for tech and creative roles)

Common mistakes to avoid

What goes wrong when appointment letters are signed the traditional way.

Issuing the appointment letter without verifying the candidate's documents (Aadhaar, PAN, previous employment proof), which can cause legal issues during background checks later

Forgetting to reference the company's code of conduct, leaving a gap in enforceability for disciplinary matters

Not including the IP assignment clause, which becomes critical for engineering and creative hires

Missing the EPF and ESI registration numbers, which employees need for their own HR formalities

Using generic templates without customizing for the specific role and department

Legally valid under Indian law

Appointment letters are fully eligible for Aadhaar eSign under Section 3A of the IT Act, 2000. Since they document the employment contract between employer and employee, they benefit from the same electronic signature recognition as any other commercial agreement. The eSigned appointment letter is accepted by banks for salary account opening, by the Provident Fund office for EPF registration, and by tax authorities for TDS compliance.

Frequently asked questions

What's the difference between an offer letter and an appointment letter?
An offer letter is sent to the candidate BEFORE they join, confirming the offer and terms. An appointment letter is issued AFTER they've accepted and are joining, finalizing the employment. Some companies combine both into a single document.
Is an eSigned appointment letter accepted by banks for salary accounts?
Yes. All major banks in India accept Aadhaar eSigned appointment letters as proof of employment for salary account opening. The cryptographic signature can be verified by the bank's KYC team.
Can we issue appointment letters before the employee joins?
Yes. You can issue and eSign the appointment letter on or before the joining date. Some companies issue it on day one after physical verification; others send it in advance.
Do we need to register the appointment letter anywhere?
No. Appointment letters don't require registration with any government authority. The eSigned PDF is sufficient as a legal record between employer and employee.
How do we handle appointment letter changes or corrections?
If you need to correct a mistake after signing, issue a new appointment letter with the correction and have the employee sign it again. The old one should be marked as superseded in your records.
Can we eSign appointment letters for blue-collar workers without Aadhaar?
Aadhaar is required for the Aadhaar eSign method. If the employee doesn't have Aadhaar, you'll need to use physical signing or a Digital Signature Certificate. In practice, most employees in India have Aadhaar since it's mandatory for many purposes.
How much does it cost to eSign an appointment letter?
₹15 per signature. Most appointment letters need 2 signatures (HR representative and employee), so ₹30 total. No subscription required.
