Is an eSigned rent agreement legally valid in India?
Yes. Aadhaar eSign is recognized under Section 3A of the Information Technology Act, 2000 and the IT (Electronic Signature) Rules, 2015. An eSigned rent agreement has the same legal standing as a handwritten signature and is admissible in court under Section 65B of the Indian Evidence Act (Section 63 of the Bharatiya Sakshya Adhiniyam, 2023).
Do I still need stamp paper?
Yes. Aadhaar eSign authenticates the parties and makes the signatures legally valid, but your state's stamp duty rules still apply. The typical workflow is: draft or receive your rent agreement, pay the stamp duty (via e-stamp paper in most states), then upload the PDF to SignSetu to eSign it. The properly stamped + eSigned document is legally admissible.
What if my landlord or tenant doesn't have an Aadhaar?
Aadhaar is required for Aadhaar eSign. It is how identity is verified via UIDAI. If a signer doesn't have Aadhaar, they cannot use this method. For rent agreements, this is rare since Aadhaar is mandatory for most banking and identity use cases in India. If Aadhaar isn't available, you'll need to use a physical signature or a Digital Signature Certificate (DSC).
Can my landlord be in another city or country?
Yes. Both signers can be anywhere in the world. When adding signers, you only need to provide their name and email address. The signing link goes to their inbox. At the time of signing, each signer enters their Aadhaar number and must have their Aadhaar-linked phone physically with them to receive the OTP from UIDAI. NRIs routinely use SignSetu to rent out their Indian properties without flying back to India.
Will my housing society or RWA accept an eSigned agreement?
Most housing societies accept eSigned rent agreements because they carry the same legal validity as physical signatures. The eSigned PDF includes a cryptographic certificate from the Certifying Authority that society managers can verify in Adobe Reader or the CCA portal. If your society has specific concerns, show them Section 3A of the IT Act 2000 and Rule 3 of the IT (Electronic Signature) Rules, 2015.
Is an eSigned rent agreement accepted by banks for HRA proof?
Yes. Aadhaar eSigned rent agreements are accepted by employers, banks, and tax authorities as proof of rent payment for HRA (House Rent Allowance) claims. The signed PDF includes verification metadata that satisfies audit requirements.
Can I use this for commercial rent agreements?

What about registration with the sub-registrar?
