An internship offer letter is a formal document issued by an employer to a student or early-career candidate offering them a structured internship opportunity. It specifies the internship duration, the stipend (if any), the reporting manager, the scope of work, the learning objectives, and the conditions attached to the internship such as maintaining confidentiality, meeting weekly deliverables, and adhering to company policies.

In India, internships are not treated as formal employment in most cases, so the legal framework is much lighter than for full-time roles. Interns are typically not covered by the Provident Fund Act or the Employees' State Insurance Act, and the minimum wage floor that applies to formal workmen does not strictly apply. However, the Indian Contract Act, 1872 still governs the internship as a contractual engagement, which means the offer letter is binding once accepted. Employers must still meet obligations on health and safety, particularly for physical internships, and some sectors (like banking, CA firms, and medical colleges) have regulator-mandated internship structures with specific stipend floors.

Legally valid under Indian law

The underlying contract framework is governed by the Indian Contract Act, 1872, which treats the internship engagement as a valid contract once offered and accepted. Interns are generally not covered by the Employees' Provident Funds and Miscellaneous Provisions Act, 1952 or the Employees' State Insurance Act, 1948, because they are not considered 'employees' for the purposes of these statutes in most cases. Minimum wage requirements under the Minimum Wages Act, 1948 also do not strictly apply to internships, though many employers voluntarily offer stipends aligned with college guidelines or platform norms. Some regulated sectors have specific rules: chartered accountancy articleship stipends are set by ICAI, medical internships have Medical Council guidelines, and bank internships follow RBI or employer-specific norms. For general internships, the offer letter is the primary legal document establishing terms.
