What is Non-Disclosure Agreement?

A Non-Disclosure Agreement (NDA), also called a confidentiality agreement, is a legal contract between two or more parties that establishes a confidential relationship. The parties agree that certain information shared between them will not be disclosed to third parties. In India, NDAs are governed by the Indian Contract Act, 1872 as well as equitable principles around confidentiality. Legal validity of an eSigned NDA

NDAs are fully eligible for Aadhaar eSign under Section 3A of the IT Act, 2000. The underlying contract framework (Indian Contract Act, 1872) recognizes electronic contracts as valid. An eSigned NDA is enforceable in Indian courts and admissible as evidence under Section 65B of the Indian Evidence Act. For additional protection, some parties choose to have the NDA on stamp paper (usually ₹100-500 depending on the state), though this is not strictly required for enforceability.

Do I need to put the NDA on stamp paper?
