What is Service Agreement?
A service agreement is a contract between a service provider (freelancer, agency, consultant, or vendor) and a client that defines the services to be performed, the payment terms, deliverables, timelines, and the responsibilities of each party. It's the foundation of most B2B and freelance relationships in India and is critical for both legal protection and expectation-setting.
Service agreements are governed by the Indian Contract Act, 1872 and are enforceable in Indian courts as long as the essential elements of a contract exist (offer, acceptance, consideration, competent parties, free consent, lawful object). Unlike employment contracts, service agreements don't create an employer-employee relationship — they establish an independent contractor arrangement.
The biggest friction in traditional service agreements is the back-and-forth of printing, signing, and scanning between the service provider and the client. Aadhaar eSign reduces this to under 5 minutes total — draft, upload, add both parties as signers, and both sign with Aadhaar OTP from their own city.

Legal validity of an eSigned service agreement
Service agreements are fully eligible for Aadhaar eSign under Section 3A of the IT Act 2000. Since they're commercial contracts governed by the Indian Contract Act, 1872, they don't require stamp paper for basic enforceability (though many businesses use ₹100-500 stamp paper for evidentiary weight). The eSigned PDF includes cryptographic signatures from both parties that satisfy the evidence requirements under Section 65B of the Indian Evidence Act. Disputes arising from service agreements can be taken to civil court or resolved via arbitration if the agreement includes an arbitration clause.

Important note
For service agreements with significant commercial value, consider using ₹500 stamp paper in addition to eSigning. This adds evidentiary weight if the agreement is ever disputed in court.
