The basics

What is an Experience Letter?

An experience letter is a formal document issued by an employer to an employee who is leaving the organization. It confirms the period of employment, the designation held, and broadly the nature of responsibilities carried out during the tenure. Unlike a relieving letter, which is primarily about formal release from the company, the experience letter is about acknowledging the work experience the employee has accumulated.

Experience letters carry significant weight in the Indian job market. They are routinely requested by the next employer during the background verification process, by universities for admission to executive education programs, and by banks for loan approvals where proof of stable employment history is required. A well-drafted experience letter signals professionalism and helps the employee's career progression, which is why most mature Indian companies issue it automatically on the last working day alongside the relieving letter.

Essential clauses to include

Make sure your experience letter includes these before you sign.

Full legal name of the employee and employee ID
Designation held at the time of exit and, if possible, previous designations during tenure
Period of employment with exact joining date and last working day
Department or business unit the employee worked in
Brief description of responsibilities and scope of work
Statement acknowledging the employee's contributions and conduct
Name, designation, and signature of the authorized HR signatory
Company letterhead details, registered address, and issuance date

Common mistakes to avoid

What goes wrong when experience letters are signed the traditional way.

Confusing the experience letter with the relieving letter and issuing only one of the two, leaving the employee short on documentation

Using vague designations like 'Executive' without specifying the function, which weakens the letter's value during background checks

Forgetting to mention the exact joining date and last working day, making the tenure ambiguous

Issuing the letter on plain paper instead of company letterhead, which reduces evidentiary value

Not including the authorized signatory's name and designation in printed form alongside the signature

Delaying issuance beyond the last working day, which creates avoidable friction with the exiting employee

Legally valid under Indian law

An experience letter is an employer-issued confirmation document and is fully eligible for Aadhaar eSign under Section 3A of the Information Technology Act, 2000. The IT (Electronic Signature) Rules, 2015 recognize Aadhaar OTP-based eSign as a valid electronic signature technique. There is no Indian statute that prescribes a mandatory format for experience letters, so employers have flexibility in drafting. What matters legally is that the letter is signed by an authorized signatory (typically HR head, manager, or director) and is issued on company letterhead or company-branded PDF. Since only the employer signs, this is a single-party document. The eSigned PDF is accepted by background verification firms, banks processing loans, and universities screening candidates. It is admissible as electronic evidence under Section 63 of the Bharatiya Sakshya Adhiniyam, 2023 (previously Section 65B of the Indian Evidence Act). Most mature Indian employers, following NASSCOM guidelines and general industry practice, issue experience letters automatically on the last working day without the employee having to formally request them.

Frequently asked questions

Is an eSigned experience letter valid for background verification?
Yes. Background verification companies in India accept Aadhaar eSigned experience letters as valid proof of previous employment. The cryptographic verification metadata on the PDF allows any third party to confirm authenticity instantly.
What's the difference between an experience letter and a relieving letter?
A relieving letter confirms the formal release of the employee from the company, typically on the last working day. An experience letter acknowledges the period and nature of employment. Most companies issue both documents together, but they serve different purposes.
Does the employee also need to sign the experience letter?
No. The experience letter is a single-party document signed only by the employer (the authorized HR signatory). It is a confirmation of facts, not a contract requiring mutual agreement.
Can we issue an experience letter years after the employee left?
Yes. Ex-employees sometimes request experience letters for new opportunities, visa applications, or university admissions. You can issue and eSign the letter based on your HR records regardless of when the employee left.
Is the letter accepted by banks for loan applications?
Yes. Banks accept Aadhaar eSigned experience letters as proof of previous employment when assessing creditworthiness, particularly for personal loans and home loans where employment history matters.
Is a experience letter format different for teachers?
The core structure of a experience letter is the same across roles, but the teacher version typically emphasizes subjects taught, grade levels handled, years of classroom experience, and any administrative or extracurricular responsibilities. The legal framework under the IT Act 2000 and Indian Contract Act is identical regardless of profession.
Can a experience letter for a teacher be eSigned?
Yes. Aadhaar eSign under Section 3A of the IT Act 2000 is valid for experience letters across all professions including teachers. The eSigned document is accepted for employer records, registration with professional councils, and next-employer background verification.
