Frequently Asked Questions
Can I eSign a Power of Attorney?
It depends on the type. General POA and limited POA for movable assets, financial matters, and legal representation CAN use eSign. POA for immovable property sale/transfer CANNOT use eSign — it must be physically signed, stamped, and registered.
Does a POA need to be registered?
POA for immovable property transactions must be registered under Section 17 of the Registration Act. General POA may optionally be registered for added legal weight. Registration involves presentation before the Sub-Registrar.
Can a POA be revoked?
Yes. A POA can be revoked by the Principal at any time by executing a deed of revocation. If the POA was registered, the revocation should also be registered and the Agent must be notified.
Is a POA valid if the Principal dies?
No. A POA automatically terminates upon the death of the Principal. Any actions taken by the Agent after the Principal's death are legally void.
Can an NRI execute a POA?
Yes. NRIs commonly use POA to manage property and financial affairs in India. The POA can be executed at an Indian consulate abroad, or in India before a Notary Public. For property transactions, the POA must be registered.
