What is a Power of Attorney?

A Power of Attorney (POA) is a legal document that authorises one person (the Agent or Attorney) to act on behalf of another (the Principal) in specified legal, financial, or property matters. It is governed by the Powers of Attorney Act, 1882. A General POA grants broad authority, while a Special/Limited POA restricts authority to specific acts. POA is widely used by NRIs for managing property and financial affairs in India.

Stamp Duty & Registration

POA stamp duty varies significantly by state and type. General POA attracts higher stamp duty (₹500–₹5,000+ depending on state) while limited/special POA may attract lower duty. Property-related POA has specific rates in each state. The stamp duty is governed by the Indian Stamp Act, 1899 and state amendments. Always verify current rates with your state's stamp duty schedule.

Registration: POA for immovable property transactions must be registered. General POA and financial POA may need registration depending on state laws.

Can a Power of Attorney Be Signed with Aadhaar eSign?

IMPORTANT: Power of Attorney for immovable property sale/transfer CANNOT use Aadhaar eSign — it is excluded under Schedule I of the IT Act, 2000. General POA and financial POA for movable assets CAN use eSign.
Partially eligible — with important limitations. Under Schedule I of the IT Act, 2000, Power of Attorney as it relates to the sale or transfer of immovable property CANNOT use electronic signatures including Aadhaar eSign. This means property sale POAs must be physically signed, stamped, and registered. However, General POA for financial matters, movable property, legal representation, and other non-immovable-property purposes CAN use Aadhaar eSign under Section 3A.

Common Mistakes to Avoid

  • ✗Using a general POA when a limited/special POA would be more appropriate and safer
  • ✗Not registering a POA for property transactions — unregistered property POA is not admissible for property transactions
  • ✗Granting overly broad powers without limitations — always limit the scope
  • ✗Attempting to eSign a POA for immovable property — this is legally void under the IT Act
  • ✗Not including a revocation mechanism

Can I eSign a Power of Attorney?

It depends on the type. General POA and limited POA for movable assets, financial matters, and legal representation CAN use eSign. POA for immovable property sale/transfer CANNOT use eSign — it must be physically signed, stamped, and registered.

Does a POA need to be registered?

POA for immovable property transactions must be registered under Section 17 of the Registration Act. General POA may optionally be registered for added legal weight. Registration involves presentation before the Sub-Registrar.

Can a POA be revoked?

Yes. A POA can be revoked by the Principal at any time by executing a deed of revocation. If the POA was registered, the revocation should also be registered and the Agent must be notified.

Is a POA valid if the Principal dies?

No. A POA automatically terminates upon the death of the Principal. Any actions taken by the Agent after the Principal's death are legally void.

Can an NRI execute a POA?

Yes. NRIs commonly use POA to manage property and financial affairs in India. The POA can be executed at an Indian consulate abroad, or in India before a Notary Public. For property transactions, the POA must be registered.
