What is a Affidavit?

An affidavit is a written statement of facts made under oath or solemn affirmation, used as evidence in legal proceedings or for official purposes. Under the Indian Evidence Act, 1872 (Section 3), an affidavit is defined as a statement in writing made under oath. Common uses include name change declarations, address proof, income declarations, property disputes, and court filings. Making a false statement in an affidavit is a criminal offence under Sections 191 and 193 of the Indian Penal Code (now Bharatiya Nyaya Sanhita).

Affidavits require stamp paper in most Indian states. The denomination is typically ₹10–₹100 depending on the state. In Maharashtra, affidavits require ₹100 stamp paper. In Delhi, ₹10 is common for general affidavits. E-stamp paper is available in most states. The stamp duty requirement is under the Indian Stamp Act, 1899.
